We investigate two under-explored factors in mitigating the risk of corporate fraud and regulatory enforcement against fraud, namely institutional investors and political connections. The role of institutional investors in the effective monitoring of a firm’s management is well established in the literature. We further observe that firms that have a large proportion of their shares held by institutional investors have a lower incidence of enforcement actions against corporate fraud. The importance of political connections for enterprises, whether in a developed market (...) such as the United States or an emerging market such as China, has been established by previous studies. However, we find evidence of another positive effect of political connections: they may reduce the incidence of enforcement action against corporate fraud. We also find that political connections play a more significant role in reducing regulatory enforcement incidents against non-state-owned enterprises and firms in weaker legal environments, whereas institutional ownership plays a more important role in reducing regulatory enforcement incidents against state-owned enterprises. PurposeThe COVID-19 lockdown interrupted normal daily activities, which may have led to an increase in sedentary behavior. The aim of this study was to investigate the effect of the COVID-19 pandemic on the level of physical activity among Swiss office workers.MethodsOffice workers from two Swiss organizations, aged 18–65 years, were included. Baseline data from January 2020 before the COVID-19 pandemic became effective in Switzerland were compared with follow-up data during the lockdown phase in April 2020. Levels of physical activity were (...) assessed using the International Physical Activity Questionnaire. Paired sample t-tests or Wilcoxon signed-rank test were performed for statistical analysis.ResultsData from 76 participants were analyzed. Fifty-four participants were female. The mean age was 42.7 years at baseline. About 75% of the participants met the recommendations on minimal physical activity, both before the COVID-19 pandemic and during the lockdown. Weak statistical evidence for a decline in total physical activity in metabolic equivalent of task minutes per week was found, with no evidence for a decrease in the three types of activity: walking, moderate-intensity activity and vigorous-intensity activity. Across the three categories “high,” “moderate,” and “low” physical activity, 17% of the participants became less active during the lockdown while 29% became more active.ConclusionThe COVID-19 pandemic did not result in a reduction in total physical activity levels among a sample of Swiss office workers during the first weeks of lockdown. Marcus Giaquinto claims that finite cardinal numbers are sensible properties, and that the smallest ones are known by acquaintance. In this paper I compare Giaquinto’s epistemology to the Russellian one with which it invites comparison, before showing how it is subject to a version of Jody Azzouni’s “epistemic role” objection. Then I argue that the source of this problem is Giaquinto’s misconception that numbers, like quantities, are sensible properties. Finally, I offer a sketch of a theory of how we grasp (...) finite cardinals on the assumption that they are not sensible, and show why this is not subject to the epistemic role objection. (shrink)

We all learn about the mistake of treating ‘nothing’ as if it were a term standing for something; but is it a mistake to treat it as an empty term, denoting nothing? We argue not, and we introduce ‘zilch’, defined as ‘the non-self-identical thing’, as a term which is empty as a matter of logical necessity. We contrast its behaviour with that of the quantifier ‘nothing’, and illustrate its uses. We use the same idea to vindicate Locke’s, Descartes’ and Hume’s (...) handling of ‘nothing’, and we show how Heidegger’s ‘das Nichts nichtet’ comes out as logically true. (shrink)

For at least the last twenty years, philosophers have attempted various strategies for reviving the Hegelian notion of recognition and redeploying it in discourses centered around social justice, including multiculturalism, feminism, race theory, and queer theory. Hegel’s master-slave dialectic may seem like an obvious place to start to analyze the oppression of one group by another. Gender researchers have only recently begun to identify how women perceive and explain the costs and benefits associated with different femininities. Yet status hierarchies among historically white college sororities are explicit and cannot be ignored, forcing sorority women to grapple with constructions of feminine worth. Drawing on interviews with women in these sororities, we are able to capture college women’s attitudes toward status rankings that prioritize adherence to narrow models of gender complementarity. Sorority chapters were ranked according to women’s perceived (...) heterosexual appeal to elite men. Women believed that top-ranked sororities conferred social power whereas middle- and bottom-ranked sororities offered greater freedom from policing over members’ bodies, fashion, and socializing. However, middle- and bottom-ranked sororities sometimes sought to rise in the rankings. When this occurred, existing members were marginalized, and a new pledge class with a greater tolerance for socializing with high-status “rapey” fraternities was sought. Women’s discussions of sorority rankings show evidence of a hybrid femininity that fuses practices from traditional models of gender complementarity and more recent models of women’s empowerment. In his 2015 book, Valuing Health, the philosopher, Daniel Hausman, in referring to experienced utility maximization, touches on the question of whether people accept, and ought to accept, the assumption of health maximization vis-à-vis their own lives. This essay introduces Hausman’s arguments on experienced utility, before outlining the intellectual catalyst for the renewed interest in the maximization of experienced utility as an appropriate ethical rule; namely, the literature that arose in the 1990s that demonstrated that due to the so-called gestalt (...) characteristics, an individual’s retrospective and prospective assessments of an event—i.e. the remembered and decision utilities associated with that event—often systematically differ from the utility that he/she experiences or can reasonably expect to experience during the same event. The essay then touches upon some of the implications that this debate has on assuming that the maximization of quality-adjusted life years is the best way to judge the relative worth of different health profiles. To conclude, it is argued that, although contextual, it is sometimes important to consider in the policy discourse the apparent effects of the gestalt characteristics on remembered and decision utility. Increasing interest in farmers’ local soil knowledge and soil management practice as a way to promote sustainable agriculture and soil conservation needs a reliable means to connect to it. This study sought to examine if Visual Soil Assessment and farmer workshops were suitable means to engage, communicate and preserve farmers’ LSK in two mountainous communes of Central Vietnam. Twenty-four farmers with reasonable or comprehensive LSK from previously studied communes were selected for the efficacy of VSA and farmer workshops for integrating (...) LSK into a well-accepted soil assessment tool. In field sites chosen by the farmers, VSA was independently executed by both farmers and scientists at the same time. Close congruence of VSA scores between the two groups highlighted that farmers could competently undertake VSA. Farmers’ VSA score was compared with their perception of field’s soil quality. For the majority of farmers’ perception of soil quality was consistent to their VSA score, while the remainder perceived their soil quality was lower than their VSA score. For most farmers their assessment of soil quality using VSA valued their LSK, and the two measures were well aligned. Soil colour and presence or vulnerability to erosion were common soil characteristics mentioned by farmers and affected the final VSA score. Farmers’ participation in VSA and workshops strengthen farmers’ confidence in their LSK and provided guidance on the impact of their soil management on soil improvement and conservation. (shrink)

The pathologization of women’s depression covers over the social and institutional causes of that symptomology. Insofar as patriarchal values continue to devalue and debase women and mothers in ways that colonize psychic space, and depression becomes a cover for what I call ‘social melancholy.’ This is not the melancholy of traditional psychoanalysis, but a form of melancholy that results from oppression, domination, and the colonization of psychic space. Social melancholy differs from both Freud’s notion of melancholy in that it is (...) the result of social factors that constitute the depressed subject as ashamed and lacking agency. Crucial to my analysis is a distinction between shame and guilt missing from traditional psychoanalytic accounts of melancholy and depression. (shrink)

According to the received view Feynman diagrams are a bookkeeping device in complex perturbative calculations. Thus, they do not provide a representation or model of the underlying physical process. This view is in apparent tension with scientific practice in high energy physics, which analyses its data in terms of “channels”. For example the Higgs discovery was based on the observation of the decay H → γγ – a process which can be easily represented by the corresponding Feynman diagrams. Almost all set theorists pay at least lip service to Cantor’s definition of a set as a collection of many things into one whole; but empty and singleton sets do not fit with it. Adapting Dana Scott’s axiomatization of the cumulative theory of types, we present a ‘Cantorian’ system which excludes these anomalous sets. We investigate the consequences of their omission, examining their claim to a place on grounds of convenience, and asking whether their absence is an obstacle to the (...) theory’s ability to represent ordered pairs or to support the arithmetization of analysis or the development of the theory of cardinals and ordinals. The problem of collective action is that each member of a group wants other members to make necessary sacrifices while he or she 'free rides', reaping the benefits of collective action without doing the work. Inevitably the end result is that no one does the work and the common interest is not realized. This book analyses the social pressure whereby groups solve the problem of collective action. The authors show that the problem of collective action requires a model of group (...) process and cannot be deduced from simple models of individual behaviour. They employ formal mathematical models to emphasize the role of small subgroups of especially motivated individuals who form the 'critical mass' that sets collective action in motion. The book will be read with special interest by sociologists, social psychologists, economists and political scientists. Dummctt argues that classical quantification is illegitimate when the domain is given as the objects which fall under an indefinitely extensible concept, since in such cases the objects are not the required definite totality. The chief problem in understanding this complex argument is the crucial but unexplained phrase 'definite totality' and the associated claim that it follows from the intuitive notion of set that the objects over which a classical quantifier ranges form a set. 'Definite totality' is best understood as (...) disguised plural talk like Cantor's 'consistent multiplicity', although this does not help in understanding how a totality could be anything other than definite. Moreover, contrary to his claims, Dummett's own notion of set is not intuitive and he does not demystify the set-theoretic paradoxes. In conclusion, it is argued that Dummett's context principle is responsible for the incoherent projection of the haziness of a conception of some objects onto reality. (shrink)

This paper argues for the theoretical and practical validity of similarity as a useful epistemological tool in scientific knowledge generation, specifically in chemistry. Classical analyses of similarity in philosophy of science do not account for the concept’s practical significance in scientific activities. We recur to examples from chemistry to counter the claim of authors like Quine or Goodman to the effect that similarity must be excluded from scientific practices . In conclusion we argue that more recent conceptualizations of the notion (...) of similarity, particularly Giere’s one, are appropriate for a philosophical analysis that considers scientific practices on equal terms with scientific theory. Julia Kristeva was born in 1941 in Bulgaria. She was educated by French nuns, studied literature and worked as a journalist before going to Paris in 1966 to do graduate work with Lucien Goldmann and Roland Barthes. While in Paris she finished her doctorate in French literature, became involved in the influential journal Tel Quel, and began psychoanalytic training. In 1979 she finished her training as a psychoanalyst. Currently, Kristeva is a professor of linguistics as the University of Paris VII (...) and a regular visiting professor at Columbia University. In addition to her work as a practicing psychoanalyst and her theoretical writings, Kristeva is a novelist. (shrink)

Purpose – The purpose of this study is to investigate the reasons behind unethical behaviour in the Australian Information and Communications Technology workplace. Design/methodology/approach – The study employed a qualitative research methodology. A total of 43 ICT professionals were interviewed during the month of February 2014 in six Australian capital cities. All interviews were conducted face-to-face and followed a semi-structured interviewing format utilising open-end questions and further probing questions. The purposive sample represented ICT professionals from large and small organisations, government (...) and private sector, different geographic locations, ages, genders, types of jobs and employment experience. Data analysis was completed with the help of QSR NVivo 10, a software package for managing qualitative data. Findings – Of the 25 reasons identified for unethical behaviour in ICT workplaces, 30 per cent of participants agreed on five major ones: pressure, bad management, greed, lack of respect towards ICT and communication issues. Practical implications – By focussing on the reasons behind unethical behaviour in the Australian ICT workplace, this article helps those identifying strategies for dealing with unprofessional behaviour to take into account the root causes of unprofessional behaviour. Originality/value – There is hardly any literature on reasons for unethical behaviour in the ICT workplaces. This article seeks to address this imbalance in the literature. Also, integrity systems in ICT are a new focus in collective, organisational ethics. Identification of and resolving unethical ICT workplace practice is an innovative contribution to the literature. Lack of consent is valorized within popular culture to the point that sexual assault has become a spectator sport and creepshot entertainment on social media. Indeed, the valorization of nonconsensual sex has reached the extreme where sex with unconscious girls, especially accompanied by photographs as trophies, has become a goal of some boys and men.

Reciprocal interactions between the host circadian clock and the microbiota are evidenced by recent literature. Interestingly, dysregulation of either the circadian clock or microbiota is associated with common human pathologies such as obesity, type 2 diabetes, or neurological disorders. However, it is unclear to what extent a perturbation of pathways regulated by both the circadian clock and microbiota is involved in the development of these disorders. It is speculated that these perturbations are associated with impaired growth hormone (GH) secretion and (...) sexual development. The GH axis is a broadly neglected pathway and could be the main converging point for the interaction of both circadian clock and microbiota. Here, the links between the circadian clock and microbiota are reviewed. Finally, the effects of chronodisruption and dysbiosis on physiology and pathology are discussed and it is speculated whether a common deregulation of the GH pathway could mediates those effects. My short essay on Irigaray’s relation to Nietzsche could be divided into the beginnings of six arguments: First, Nietzsche continues to hold a special place in Irigaray’s thinking. Second, Amante Marine is an important part of Irigaray’s elemental philosophy. Third, Irigaray’s insistence on depth over surface in Amante Marine points to two different ways Nietzsche has been taken up in French Philosophy, which could be characterized as the difference between surface and depth. Fourth, Irigaray’s Amante Marine anticipates the most recent (...) direction in Nietzsche scholarship, which focuses on plants and the earth. Fifth, following Nietzsche, Irigaray suggests that we can learn lessons about sharing the earth from plants. And, finally, Irigaray’s elemental philosophy resonates with my own conception of earth ethics as responsiveness to other earthlings and our environment, which I develop in my recent book Earth and World. Performing two cognitively demanding tasks at the same time is known to decrease performance. The current study investigates the underlying executive functions of a dual-tasking situation involving the simultaneous performance of decision making under explicit risk and a working memory task. It is suggested that making a decision and performing a working memory task at the same time should particularly require monitoring—an executive control process supervising behavior and the state of processing on two tasks. To test the role of a (...) supervisory/monitoring function in such a dual-tasking situation we investigated 122 participants with the Game of Dice Task plus 2-back task (GDT plus 2-back task). This dual task requires participants to make decisions under risk and to perform a 2-back working memory task at the same time. Furthermore, a task measuring a set of several executive functions gathered in the term concept formation (Modified Card Sorting Test, MCST) and the newly developed Balanced Switching Task (BST), measuring monitoring in particular, were used. The results demonstrate that concept formation and monitoring are involved in the simultaneous performance of decision making under risk and a working memory task. In particular, the mediation analysis revealed that BST performance partially mediates the influence of MCST performance on the GDT plus 2-back task. These findings suggest that monitoring is one important subfunction for superior performance in a dual-tasking situation including decision making under risk and a working memory task. (shrink)

I challenge the age-old binary opposition between human and animal, not as philosophers sometimes do by claiming that humans are also animals, or that animals are capable of suffering or intelligence, but rather by questioning the very category of “the animal” itself. This category groups a nearly infinite variety of living beings into one concept measured in terms of humans—animals are those creatures that are not human. In addition, I argue that the binary opposition between human and animal is intimately (...) linked to the binary opposition between man and woman. Furthermore, I suggest that thinking through animal differences or differences among various living creatures opens up the possibility of thinking beyond the dualist notion of sexual difference and enables thinking toward a multiplicity of sexual differences. Objetivamos elaborar um balanço sobre lógica das perguntas científicas na produção do conhecimento stricto sensu. Tomamos como fontes 100 dissertações e 32 teses escritas por docentes que trabalham em cursos de Educação Física no Estado da Bahia – 1982 a 2018, abordando enquanto objeto a lógica instituída pelas perguntas científicas na referida produção. Trata-se de uma pesquisa documental, tendo como método o materialismo histórico e dialético. Os resultados apontam que 48% das produções têm suas perguntas de investigação construída a partir (...) da lógica formal; 28% apresenta uma lógica dialética na elaboração das perguntas científicas; e 24% não apresentam problema de investigação. Although naming-and-shaming (shaming) is a commonly used tax enforcement mechanism, little is known about the efficacy of shaming tax evaders. Through two experiments, this study examines the effects of shaming tax evaders on third-party observers’ perceptions of retributive justice and tax compliance intentions, and whether the salience of persuasion of observers moderates these relationships. Based on insights from defiance theory, the message learning model, and persuasive communications, this study predicts and finds that shaming evaders increases observers’ tax compliance intentions. Furthermore, (...) the results show that higher persuasion, which includes sanction and normative appeals, affects observers’ tax compliance intentions. This study also suggests that shaming has a positive effect on perceptions of retributive justice. Importantly, the results reveal that perceptions of retributive justice in shaming punishment mediate the effect of shaming on tax compliance intentions. The year 2017 is the year in which the Reformation, started by Martin Luther, is celebrating its 500th birthday. This depicts a milestone in the life of the Church of the Reformation and also in the life of Christians worldwide. This is a good time to ponder on the epistemological question of the validity and necessity of the Reformation. If this question is answered in a positive way, then it could bring us to the realisation that the time is ripe (...) for an African Reformation. This article will argue that this is indeed the case. A reformation, transformation and change is needed for the African Christian context. However, the question could well be asked: Who will be the 'second Luther?'. (shrink)

The knowledge driven, network society that is founded upon technology, demands from students to become independent, confident and motivated life-long, self-directed learners that can transfer their knowledge, skills and values. In order to deliver this type of graduates from a diverse and unequal student pool, effective education must be provided. Educators are encouraged to focus education on student-centeredness and to use technology effectively. Alternative assessment methods that are technology driven could enable both educators and students to become more effective in (...) this environment. This article advocates the use of alternative assessment methods by using technology driven assessment tools for possible replacement of traditional, paper based and ‘one size fits all’ assessment methods within theology. Though emotional faces preferentially reach awareness, the present study utilised both objective and subjective indices of awareness to determine whether they enhance subjective awareness and “blindsight”. Under continuous flash suppression, participants localised a disgusted, fearful or neutral face (objective index), and rated their confidence (subjective index). Psychopathic traits were also measured to investigate their influence on emotion perception. As predicted, fear increased localisation accuracy, subjective awareness and “blindsight” of upright faces. Coldhearted traits were inversely related to subjective awareness, but not (...) “blindsight”, of upright fearful faces. In a follow-up experiment using inverted faces, increased localisation accuracy and awareness, but not “blindsight”, were observed for fear. Surprisingly, awareness of inverted fearful faces was positively correlated with coldheartedness. These results suggest that emotion enhances both pre-conscious processing and the qualitative experience of awareness, but that pre-conscious and conscious processing of emotional faces rely on at least partially dissociable cognitive mechanisms. This article applies change agency to the institutions of higher education in South Africa – referring here to all the post-school institutions and educators in general and more specifically focused on the unique opportunities and responsibilities towards change agency in theological training. The focus is on the characteristics of a change agent, which could be an individual or a group. Seemingly, change is not going to be initiated in a ‘top-down’ approach; therefore, this article suggests a ‘bottom-up’ approach, starting with (...) a change agent (an individual or a group) to become enthusiastic and active to bring about change. The method of constructivism is used, complemented by a general literature review of the past 70 years, filled with definitions of change agents and change agency. After the discussion of a few models, the researcher ventures to propose a way in which change agency can find a foothold among theological educators in higher education institutions in South Africa. We examine the question of how many Boolean algebras, distinct up to isomorphism, that are quotients of the powerset of the naturals by Borel ideals, can be proved to exist in ZFC alone. The maximum possible value is easily seen to be the cardinality of the continuum $2^{\aleph_{0}}$ ; earlier work by Ilijas Farah had shown that this was the value in models of Martin's Maximum or some similar forcing axiom, but it was open whether there could be fewer in (...) models of the Continuum Hypothesis. We develop and apply a new technique for constructing many ideals whose quotients must be nonisomorphic in any model of ZFC. The technique depends on isolating a kind of ideal, called shallow, that can be distinguished from the ideal of all finite sets even after any isomorphic embedding, and then piecing together various copies of the ideal of all finite sets using distinct shallow ideals. In this way we are able to demonstrate that there are continuum-many distinct quotients by Borel ideals, indeed by analytic P-ideals, and in fact that there is in an appropriate sense a Borel embedding of the Vitali equivalence relation into the equivalence relation of isomorphism of quotients by analytic P-ideals. We also show that there is an uncountable definable wellordered collection of Borel ideals with distinct quotients. (shrink)

This volume represents the first collection of essays devoted exclusively to Jacques Derrida's Death Penalty Seminars, conducted from 1999-2001. The volume includes essays from a range of scholars working in philosophy, law, Francophone studies, and comparative literature, including established Derridians, activist scholars, and emerging scholars.

In this paper I develop a deconstructive analysis of the relationship between humanitarian aid and state sovereignty. First, I sketch Derrida's analysis of the Christian roots of contemporary concepts of tolerance, forgiveness, and hospitality. Second, I trace the history and etymology of the word ‘humanitarian’ to reveal its Christian heritage; and argue that ‘humanitarian’ is bound to the violence of Christ's crucifixion, on the one hand, and to the sovereignty of God, on the other. Third, I set out three phases (...) in the politics of contemporary humanitarian aid in relation to an increasing concern for humanitarian warfare. I conclude that international humanitarian aid and humanitarian warfare are bound together through an autoimmune logic that simultaneously challenges and shores up state sovereignty. State sovereignty creates ‘refugees’, which necessitates humanitarian aid organizations to step in and literally fill the space between state borders, a space that has become a kind of ‘no-man's land’ beyond citizenship. Police and military respond to refugee camps by patrolling them to shore up national borders and state sovereignty. Non-governmental humanitarian aid organizations, supposedly operating outside of nation states, become a necessary supplement to state sovereignty. (shrink)

This collection of essays explore the long-standing,intricate relationship between law and faith. Faith in this context is to be read in the broadest sense, as extending beyond religion to embrace the knowledge, beliefs, understandings and practices which are at work alongside the familiar and seemingly more reliable, trusted and relatively certain content and conventionally accepted methods of law and legal reasoning. The essays deal with three broad themes. The first concerns the extent to which faith should be involved in legal (...) decision making. Ought decisions to aspire simply to right reason or ought faith-based models of decision-making to be incorporated into the legal system? If the latter, how is this best done? Ought faith to operate simply as a reason itself or ought it to help to structure the method by which legal decisions are reached? The second, and perhaps most familiar theme, stemming in part from rights discourse, is the extent to which law does, and ought to, respect the rights of those whose religious beliefs conflict with the dominant social norms and practices. Liberal democratic constitutions typically provide protection for religion and religious beliefs. Are these justified, and if so how? Can such protection as exists suffice from the perspective of the faithful, or does law's otherwise pervasive agnosticism make this impossible or illusory? Thirdly, questions of identity and difference arise. Assuming that most societies remain a mix of many faiths (religious and secular) and no faith, how should law and legal theory understand the varying and, it must be said, conflicting claims for recognition. Should we encourage conformity in the hope of reducing friction, or should we preserve and promote difference, seeking to understand others, whether groups or individuals, without removing that which makes them distinct? More radically and controversially, should we be more sceptical of individual and group claims to authenticity and see them rather as strategies in an ongoing power game? Faith after all, like reason and law, has never been far from politics and intrigue, especially in its institutional representation. P-adic logarithms are used to translate localization sequences, involving multiplicative groups of units, to simpler additive descriptions of [italic]D([double-struck]Z[italic]G) and [bold]Wh′([italic]G) for the [italic]p-group [italic]G. The goal of this paper is to work out a procedure for using logarithms to translate the localization sequences in to sequences involving additive groups.

The study has two objectives: to introduce grip force recording as a new technique for studying embodied numerical processing; and to demonstrate how three competing accounts of numerical magnitude representation can be tested by using this new technique: the Mental Number Line, A Theory of Magnitude and Embodied Cognition account. While 26 healthy adults processed visually presented single digits in a go/no-go n-back paradigm, their passive holding forces for two small sensors were recorded in both hands. Spontaneous and unconscious grip (...) force changes related to number magnitude occurred in the left hand already 100–140 ms after stimulus presentation and continued systematically. Our results support a two-step model of number processing where an initial stage is related to the automatic activation of all stimulus properties whereas a later stage consists of deeper conscious processing of the stimulus. This interpretation generalizes previous work with linguistic stimuli and elaborates the timeline of embodied cognition. We hope that the use of grip force recording will advance the field of numerical cognition research. (shrink)

I argue that although in “The Gender/Science System,” Keller intends to formulate a middle ground position in order to open science to feminist criticisms without forcing it into relativism, she steps back into objectivism. While she endorses the dynamic-object model for science, she endorses the static-object model for philosophy of science. I suggest that by modeling her methodology for philosophy on her methodology for science her philosophy would better serve her feminist goals.

Julia Kristeva is known as rejecting feminism, nonetheless her work is useful for feminist theory. I reconsider Kristeva's rejection of feminism and her theories of difference, identity, and maternity, elaborating on Kristeva's contributions to debates over the necessity of identity politics, indicating how Kristeva's theory suggests the cause of and possible solutions to women's oppression in Western culture, and, using Kristeva's theory, setting up a framework for a feminist rethinking of politics and ethics.
